ARIIX operated as a registered direct-selling company; the notes below report only cited findings and allegations and should not be read as a verdict.

• FTC Notice of Penalty Offenses (October 2021). ARIIX appears among the 1,100-plus companies that received the FTC's October 2021 Notice of Penalty Offenses Concerning Money-Making Opportunities [web]. Important context: the FTC itself states that inclusion on this list is not an indication that a company has done anything wrong. The notice was a broad, industry-wide warning that misrepresenting likely earnings is unlawful, and it was sent to a large cross-section of MLMs [web].

• FCPA internal investigation. After acquiring ARIIX, NewAge disclosed that a December 2020 internal investigation, conducted with outside counsel, identified conduct in ARIIX's international business practices that potentially violated the U.S. Foreign Corrupt Practices Act. NewAge voluntarily disclosed this to the U.S. Department of Justice and the SEC in August 2021 [web]. Available public records reviewed here indicate this was a disclosed investigation with stated cooperation and remediation; they do not show that formal charges or a final finding of an FCPA violation resulted [web].

• Litigation (ARIIX as plaintiff). In ARIIX LLC v. NutriSearch Corp. ARIIX was a United States health-and-wellness direct-selling (multi-level marketing) company founded in 2011 and headquartered in Utah. It was started by former senior executives of the MLM supplement company USANA, led by Fred Cooper (CEO) and Mark Wilson [web]. The company sold consumer packaged goods across several in-house brands, including Nutrifii (nutritional supplements), Slenderiiz (weight management), and Puritii (water and air filtration), distributed through a network of independent representatives [web].

By 2019 the company described itself as one of the faster-growing companies in the direct-selling industry.
